Terms of Service

1. Acceptance

By accessing or using Alters at app.createalters.com (the "Service"), operated by BSD Marketing Solutions, 86-90 Paul Street, London, EC2A 4NE, United Kingdom, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old to use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Service Description

Alters is an AI-powered video advertisement generation platform. You create campaign briefs describing your offer and target audience, the AI generates conversion-focused scripts, you select an AI presenter and voice, and the Service produces ready-to-use video advertisements.

The Service integrates with ElevenLabs for text-to-speech voice generation. The Service is provided "as is" and features may be added, modified, or removed at our discretion.

3. Account Registration

You may register via email or Google OAuth through Supabase. You are limited to one account per person and must provide accurate information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately at support@createalters.com if you suspect unauthorised access.

4. Credit System & Pricing

The Service operates on a credit-based system:

Add-on credit packs: 250 credits / $49, 500 credits / $89, 1,000 credits / $149.

Credit costs per action:

• Standard script generation: 1 credit
• Advanced script generation: 3 credits
• ElevenLabs voice generation (per 30 seconds): 5 credits
• Video sync (per video): 25 credits

Unused credits roll over and accumulate month to month for the duration of your subscription. Credits are forfeited if your subscription is cancelled. We reserve the right to change pricing with reasonable notice.

5. Billing & Refunds

• Subscription fees are billed monthly in USD via Stripe and auto-renew unless cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period - no prorated refunds are issued.
• Credits are non-refundable, whether from subscription allocations or add-on pack purchases.
• If a payment fails, we may suspend access to the Service until the payment issue is resolved.
• All prices are exclusive of applicable taxes, which will be added where required by law.

6. Acceptable Use

You agree not to use the Service to:

• Create content that is illegal, defamatory, obscene, or hateful
• Infringe on intellectual property rights of any third party
• Create deepfakes or videos impersonating real individuals without their explicit consent
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Circumvent usage limits, credit restrictions, or plan feature gates
• Share account credentials with third parties or operate multiple accounts
• Resell, sublicense, or redistribute the Service or access to it
• Send spam or unsolicited bulk communications using content generated by the Service
• Interfere with the infrastructure, security, or performance of the Service

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. Intellectual Property & Content

Platform IP

BSD Marketing Solutions owns all rights in the Service, including the platform code, branding, AI models, and user interface. AI presenter likenesses are licensed for use within the Service and in videos generated by the Service.

Your content

You retain ownership of the campaign briefs, offer descriptions, and other text you input into the Service.

AI-generated scripts

Scripts generated by the AI are licensed to you for unrestricted commercial use. You may use, modify, and distribute these scripts as you see fit.

Generated videos

You are granted a non-exclusive, perpetual, worldwide licence to use generated videos for advertising and marketing purposes. You may not extract or redistribute AI presenter likenesses as standalone assets separate from the generated videos.

8. AI Content Disclaimer

AI-generated content may not always be accurate, complete, or appropriate for your use case. You are solely responsible for reviewing all scripts and videos before publishing or distributing them. We make no guarantees regarding advertising performance, conversion rates, or legal compliance of generated content. You must ensure your use of generated content complies with applicable advertising standards, including but not limited to the ASA (UK), FTC (US), and other relevant regulatory bodies in your jurisdiction.

9. Third-Party Services

The Service integrates with third-party providers including Supabase (authentication and database), Stripe (payment processing), and ElevenLabs (text-to-speech). Your use of these services is governed by their respective terms and privacy policies. We are not liable for outages, data handling, or other issues caused by third-party service providers.

10. Service Availability

We do not guarantee any specific uptime or availability of the Service. We may modify, suspend, or discontinue features or the entire Service at any time. Where practicable, we will provide advance notice of material changes.

11. Limitation of Liability

To the maximum extent permitted by law, BSD Marketing Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our maximum aggregate liability for all claims arising out of or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the UK Consumer Rights Act 2015 and equivalent local consumer protection legislation.

12. Indemnification

You agree to indemnify and hold harmless BSD Marketing Solutions, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, content you create or distribute, or your breach of these Terms.

13. Termination

• By you: You may cancel your subscription at any time through the billing section and contact support@createalters.com to request account deletion.
• By us: We may suspend or terminate your account for violations of these Terms, fraudulent activity, or at our discretion with reasonable notice.

Upon termination, your access to the Service ends immediately. Remaining credits are forfeited. Generated assets will be deleted 30 days after account termination. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from these Terms. Nothing in these Terms affects your statutory consumer rights under the laws of your country of residence.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BSD Marketing Solutions regarding your use of the Service, and supersede all prior agreements or understandings.

17. Changes

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
